The service is provided free of charge, openly accessible, without registration, for purely informational purposes.
2. Acceptance of Terms
By accessing, browsing or otherwise using the MyTaormina service (website, web app, related content), the user declares having read, understood and fully accepted these Terms of Service and the Privacy Policy. If the user does not agree to any part of these Terms, they must refrain from using the service.
3. Nature of the service — informational, not professional
The content published on MyTaormina (texts, place sheets, itineraries, maps, practical information, images, data) has purely informational, editorial and cultural purposes.
The content does not constitute, in any case:
- Tourist, professional or personalised advisory
- Any guarantee of accuracy, completeness, currency or adequacy of the information
- Qualified or personalised recommendations of operators, places or services
- Technical, legal, health, tax, safety or other specialist opinions
The opinions expressed reflect the personal viewpoint of the author at the time of publication and may change over time.
4. Disclaimer on third-party information and operators
MyTaormina may cite places, operators, events, products or services of third parties (museums, monuments, restaurants, hotels, B&Bs, hospitality businesses, transport, parking, attractions, event organisers, retailers, etc.) for purely descriptive, editorial and informational purposes.
The Publisher provides no warranty whatsoever as to accuracy, completeness, currency, truthfulness, safety, quality or availability of any information, including without limitation:
- Opening hours, closures, temporary suspensions, holiday schedules
- Prices of tickets, admissions, services, transport, products
- Access conditions, requirements, accessibility, stairs, routes
- Quality, professionalism, safety, hygiene or regulatory compliance of third-party operators
- Weather, traffic, ZTL (restricted traffic zones), temporary bans, roadworks
- Availability of public transport, shuttles, cable cars, parking
- Reviews, ratings, rankings or ordering of cited places and operators
The user is required to verify independently any information against official sources (official site of the operator, info points, direct phone call, competent authorities) before making travel, booking, transport or spending decisions that depend on such information.
The places, operators and third-party services cited are not commercial partners of the Publisher. The Publisher receives no compensation from the parties cited, does not select them based on commercial criteria, and provides no warranty as to the quality, professionalism, regulatory compliance or experience at such parties.
The contractual, civil, accounting, economic or other relationship between user and third-party operator is exclusively bilateral between user and operator, and is entirely outside the Publisher's sphere.
5. Disclaimer of liability
To the maximum extent permitted by applicable law, the user acknowledges and accepts that the Publisher shall not be liable in any way for:
- Direct, indirect, incidental, consequential, punitive, moral, pecuniary or non-pecuniary damages arising from the use or inability to use the service or content
- Inaccuracies, errors, omissions, typos, imprecise translations, outdated data in the content
- Variations in hours, prices, availability, conditions not promptly reflected in the content
- Experiences, disputes, damage, delays, poor service, fraud or harm at third-party operators, even if cited in the content
- Travel, purchase, booking, transport, dietary or other decisions made on the basis of the content
- Interruptions, suspensions, malfunctions, temporary errors, maintenance, cyberattacks, data loss, force majeure events
- Content, products, services, warranties, commercial practices, privacy or security policies of third-party sites, apps or platforms reachable via links in the service
- Mismatch between editorial representation and reality on the ground
- Personal injuries, accidents, illness or physical consequences during visits, excursions, routes or activities undertaken on the basis of the content
- Any consequence arising from reliance on the content for any purpose
The user acknowledges and accepts that the service is provided "as is" and "as available", without any express or implied warranty, including without limitation warranties of merchantability, fitness for a particular purpose, quality, accuracy, non-infringement, continuity, security or absence of errors.
The foregoing does not exclude or limit liability which, under mandatory applicable law, cannot be excluded or limited (in particular wilful misconduct, gross negligence and consumers' non-waivable rights under Italian Legislative Decree 206/2005).
6. Limitation of liability
As this is a free service, provided without consideration, in the absence of any synallagmatic contractual relationship, no contractual liability of the Publisher can arise towards the user for the mere use of the service, except in cases of wilful misconduct, gross negligence or violation of non-waivable consumer rights.
Should — notwithstanding the above — any liability of the Publisher be judicially established, it shall in any event be limited, to the maximum extent permitted by law, to direct, immediate and foreseeable damages only, at the time of use of the service, excluding any indirect, consequential damage, loss of profit, loss of chance, opportunities or reputation.
7. User indemnification
Subject to mandatory consumer rights under Legislative Decree 206/2005 (Italian Consumer Code), this indemnity applies to the fullest extent permitted by law.
The user undertakes to indemnify, defend and hold harmless the Publisher (and any collaborators, contractors and suppliers) from any claim, demand, complaint, action, proceeding, assessment, penalty, damage, cost or expense (including legal fees and consultancy costs) brought by third parties and arising out of or connected with:
- Breach of these Terms by the user
- Improper, unlawful or unauthorised use of the service or content
- Violation of third-party rights (intellectual property, privacy, honour, reputation, personal data, etc.) committed by the user in using the service
- Content, communications, materials or reports transmitted by the user to the Publisher or through the service
8. Acceptable use of the service
The user undertakes to use MyTaormina exclusively for personal, lawful, non-commercial purposes and in compliance with these Terms. The following is expressly prohibited, without limitation:
- Extracting, harvesting, copying, downloading, indexing, massively or systematically archiving content via scraping, crawling, bots, automated scripts, software agents, RPA or similar techniques, except as permitted under §8.1 below
- Using the service's content, in whole or in part, to train, evaluate, feed, integrate or develop artificial intelligence models, machine learning systems, datasets, LLMs or similar services, except as permitted under §8.1 below
- Reproducing, distributing, publishing, communicating to the public, modifying, translating or creating derivative works from the content without written authorisation
- Reverse engineering, decompiling, disassembling, altering or attempting to access the source code of the service
- Using the service for commercial, advertising, resale or intermediation purposes without written authorisation
- Performing acts, including attempts, that may compromise the security, integrity, availability or performance of the service (DDoS, injection, malicious fuzzing, etc.)
- Bypassing technical protection measures, access restrictions or usage limits
- Submitting or transmitting — through any forms or channels — unlawful, false, defamatory, offensive, discriminatory, obscene content, or content in violation of third-party rights or mandatory rules
8.1 Authorised automated access (robots.txt, llms.txt, ai-policy.json)
Express authorisations set out in the following files published by the Publisher remain unaffected:
https://www.mytaormina.app/robots.txt— crawler authorisations under the Robots Exclusion Protocol (RFC 9309);https://www.mytaormina.app/llms.txt— index of content accessible to AI agents (llmstxt.org convention);https://www.mytaormina.app/.well-known/ai-policy.json— machine-readable AI policy;
which constitute the binding reference for the conditions of automated access to the service. The user-agents listed therein as authorised may access the content — including for indexing, retrieval-augmented generation and AI model training purposes — on the terms, within the perimeters (allowed / disallowed paths) and in the manner specified therein, without the need for further written authorisation from the Publisher. This machine-readable signal is expressed pursuant to art. 70-quater of Italian Law 633/1941 and Recital 19 of Directive (EU) 2019/790.
This authorisation:
- applies exclusively to the Publisher's original textual content (descriptions of places, itineraries, info pages, editorial structure);
- does not extend to photographs, illustrations, maps, trademarks or other third-party materials present in the service (Unsplash, Pexels, Wikimedia Commons, OpenStreetMap, cited trademarks, etc.), whose terms of use remain those set by the respective owners and licences (Unsplash License, CC0, Public Domain, ODbL, etc.). The Publisher does not grant, nor can it grant, any further licence on such materials for AI training purposes or uses not covered by the source licences;
- does not extend to data reused from public bodies (Comune di Taormina, Parco Archeologico Naxos-Taormina, ASM Taormina, etc.) under Italian Legislative Decree 36/2006 (PSI reuse) and Directive (EU) 2019/1024, which remain governed by the licences applied by the respective holders (typically IODL 2.0 or CC BY 4.0);
- is revocable at any time by the Publisher by amending the above files, without notice, with effect from publication of the amendment;
- does not constitute a licence to republish, redistribute or communicate to the public the extracted content in its entirety, which remains governed by §9.
User-agents not listed in the above files as authorised, and access exceeding the perimeters indicated therein (in particular Disallow directives), remain subject to the prohibition set out in the first paragraph of this §8.
8.2 Rectification and removal (takedown)
Restaurateurs, business operators, event organisers, natural or legal persons mentioned in the content may request the rectification or removal of information concerning them — in particular if inaccurate, outdated, excessive or harmful — by sending a reasoned notice to info@mytaormina.app, accompanied by elements that allow the contested content and the nature of the objection to be identified.
The Publisher undertakes to provide a response within 30 days of receiving the notice and to proceed, where the request is well-founded or otherwise accepted at its sole editorial discretion, to rectify or remove the content as soon as technically possible. The Publisher retains the right to retain information of public interest and to reject manifestly unfounded or vexatious requests.
This clause does not prejudice the data subject's rights under the GDPR (arts. 16-17 of Regulation (EU) 2016/679), which remain exercisable in the manner indicated in the Privacy Policy.
8.3 Order of precedence between Terms and machine-readable signals
In case of apparent divergence between the text of these Terms (natural language) and the machine-readable files referred to in §8.1, the following interpretation rules apply:
- for natural persons and human operators, the text of these Terms prevails;
- for automated systems, crawlers, bots and AI agents, the machine-readable files (
robots.txt,llms.txt,ai-policy.json) prevail, having been deliberately published by the Publisher as a binding statement pursuant to art. 70-quater of Italian Law 633/1941 and Recital 19 of Directive (EU) 2019/790; - in either case, the more restrictive clauses prevail over the more permissive ones in case of doubt, unless the doubt itself is an explicit grant of broader permission.
Breach of these prohibitions entails immediate cessation of the right to use the service, without prejudice to any further action by the Publisher in civil and/or criminal proceedings and without prejudice to the indemnification obligation under §7.
9. Intellectual property
- Original content (itinerary texts, place sheets, descriptions, info pages, editorial structure, content selection and arrangement, non-open-source code): © Enrico Moschella — all rights reserved. Protected by Italian Law 633/1941 (copyright law) and applicable international laws.
- Database: the collection and organisation of data constitutes a protected database under arts. 102-bis et seq. of Italian Law 633/1941 (sui generis database right).
- Royalty-free photographs: used in accordance with the respective licences (Unsplash License, Pexels License, Wikimedia Commons CC0 / Public Domain, etc.); author attribution visible at the bottom of the sheets where applicable. Such licences prevail over any authorisation contained in the Publisher's
robots.txt,llms.txtorai-policy.json: the automated access authorisation granted to AI user-agents is limited to original textual content and does not constitute a licence for the reuse, redistribution or training on third-party images. - Cartography: map data © OpenStreetMap contributors (https://www.openstreetmap.org/copyright), under the Open Database License (ODbL).
- Public sector data reused under Italian Legislative Decree 36/2006: opening hours, fares, stops, routes and other factual data used in the content are drawn, where applicable, from public sources (Comune di Taormina, Parco Archeologico Naxos-Taormina, ASM Taormina, Trenitalia, Regione Sicilia) pursuant to Italian Legislative Decree 36/2006 (reuse of public sector information) and Directive (EU) 2019/1024. Editorial reworkings of such data remain covered by the protection referred to in the first bullet; the raw data remain governed by the licences applied by the source (typically IODL 2.0 or CC BY 4.0), cited where relevant.
- Third-party trademarks and distinctive signs possibly cited in the content (names of places, hotels, restaurants, events, products, etc.) belong exclusively to their respective owners and are used exclusively for editorial, descriptive, informational and nominative purposes (lawful use under applicable law). MyTaormina is in no way affiliated with, sponsored, authorised or endorsed by such parties.
The name "MyTaormina" and associated graphic elements are used by the Publisher on a factual basis. Any unauthorised use of names, trademarks, logos or confusingly similar signs is prohibited.
It is prohibited to reproduce, redistribute, republish, communicate to the public or reuse the content, in whole or in part, without prior written authorisation from the Publisher, except for the access and uses permitted under §8.1 (express authorisations via robots.txt / llms.txt / ai-policy.json), within the limits indicated therein. This exception applies exclusively to the Publisher's original texts and not to third-party materials referred to above (photographs, cartography, public-sector data, trademarks).
10. Editorial tools
The content is editorially curated by the Publisher, also with the support of software tools (including automated translation and writing-assistance solutions based on generative artificial intelligence technologies), as part of ordinary digital editorial activity. Such support does not alter the purely informational nature of the content nor the liability reservations under §3, §4 and §5.
11. Minimum age
The service is not intended for minors under 14 years of age. Minors aged between 14 and 18 may use the service under the supervision and responsibility of a parent or guardian. The Publisher does not knowingly collect data of minors under 14 (see art. 2-quinquies of Italian Legislative Decree 196/2003).
12. Links to third-party sites
The service may contain links to sites, apps, platforms or services operated by third parties. Such links are provided for the user's convenience and do not imply any verification, approval, warranty or assumption of liability by the Publisher as to content, services, products, security, privacy policies or commercial practices of the linked sites. Access to and use of third-party sites is at the user's sole risk, subject to the terms and conditions of such sites.
13. Changes to the service and Terms
The Publisher reserves the right, at its sole discretion and at any time, to:
- Modify, integrate, suspend, limit or terminate, in whole or in part, the service or its features, including without notice and without any obligation toward users
- Update these Terms, in particular in case of service evolution, regulatory changes or organisational needs
The last-updated date is always shown at the top of these Terms. The update history — with a summary list of modified sections — is available in §20. Continued use of the service after publication of the change constitutes full acceptance of the new Terms. A user who does not wish to accept may cease using the service at any time.
14. Governing law and jurisdiction
These Terms are governed exclusively by Italian law.
- For disputes with consumers under Italian Legislative Decree 206/2005, the courts of the consumer's place of residence or elected domicile shall have exclusive jurisdiction (art. 66-bis of the Italian Consumer Code).
- For disputes with non-consumers or users residing outside the European Union, the Court of Messina, Italy shall have exclusive jurisdiction, to the exclusion of any other alternative or concurrent forum.
15. Alternative Dispute Resolution (ADR)
For consumers, in the event of a dispute, the alternative dispute resolution (ADR) procedures provided by the Italian Consumer Code may be used, including the mandatory mediation under art. 5 of Italian Legislative Decree 28/2010 before commencing court action. The European ODR platform (Regulation (EU) 524/2013) was shut down on 20 July 2025 following Regulation (EU) 2024/3228.
16. Severability
Should any clause of these Terms be, in whole or in part, void, invalid, ineffective or unenforceable by law, regulation or court ruling, the remaining clauses shall remain fully valid and effective. The void or ineffective clause shall be replaced, to the extent permitted by law, by a valid provision pursuing as far as possible the original economic and legal purpose.
17. Tolerance and waiver
Any tolerance by the Publisher of user conduct not in compliance with the Terms does not constitute a waiver of its rights nor a tacit amendment of the Terms, and the Publisher retains the full right to require compliance with the clauses at any time.
18. Communications
Official communications from the user to the Publisher concerning these Terms must be sent in writing to the email addresses indicated in §1. The Publisher communicates with the user through the service or, where available, through the email addresses possibly provided by the user.
19. Final provisions
These Terms constitute the entire agreement between user and Publisher regarding the use of the service, and supersede any prior agreement, communication or understanding, written or oral, between the parties on the same subject matter.
20. Update history
Historic versions of these Terms may be requested at info@mytaormina.app. Below is a summary list of the substantial changes:
2026-06-05 — Alignment of §8 and §9 with the machine-readable files robots.txt, llms.txt and /.well-known/ai-policy.json introduced contextually:
- New §8.1: explicit carve-out for authorised automated access (crawlers and AI agents listed in the machine-readable files), limited to the Publisher's original texts, excluded for third-party images, OSM cartography and public-sector data reused under Italian Legislative Decree 36/2006.
- New §8.2: rectification and removal (takedown) procedure for businesses, event organisers and persons mentioned in the content, with a 30-day response SLA and without prejudice to GDPR rights.
- New §8.3: order-of-precedence rule between natural-language Terms (binding on human users) and machine-readable files (binding on automated agents).
- §9: added reference to the framework for reuse of public-sector information (Italian Legislative Decree 36/2006, EU Directive 2019/1024); clarified that the source licences of third-party photos prevail over any automated-access authorisation granted in the machine-readable files.
- §13: updated the change-notification mechanism, now based on the last-updated date shown at the top of the document and on this history, rather than on time-limited homepage banners.
